SofStack's Fulfillment, Refund, and Cancellation Policy

Sofstack Technology Solutions Private Limited, Sofstack Solution Private Limited, here in after referred as ‘Sofstack’, ‘we’, ‘us’ or ‘our’ is committed to respect your privacy and choices. This Fulfillment, Refund, and Cancellation Policy outlines the terms and conditions governing the provision of software development and IT consulting services (collectively, "Services") by SofStack to its clients. This Policy applies to all agreements for the provision of Services, whether entered into electronically, in writing, or orally. Please read this document carefully before engaging our services.

1. Fulfillment Policy

  • Service Delivery:

    • All services are delivered as per the agreed-upon project milestones, timelines, and deliverables specified in the client contract.

    • Deliverables may include custom software, technical documentation, programming assistance, or consultancy reports.

    • Any delays in fulfillment due to unforeseen circumstances will be communicated promptly, and a revised timeline will be shared.

  • Communication:

    • Regular progress updates are provided through agreed communication channels (e.g., email, project management tools).

    • Clients are encouraged to provide timely feedback during the development process to ensure project alignment.

  • Client Responsibilities:

    • Clients must provide the necessary inputs, resources, or access required for the successful delivery of services.

    • Failure to provide requested information or feedback may result in project delays.

2. Refund Policy

  • Eligibility for Refunds:

    • Refunds may be issued only if:

      • The project is canceled by mutual agreement before work has commenced.

      • The company is unable to deliver the agreed-upon deliverables due to its own shortcomings.

    • No refunds will be issued for:

      • Completed and delivered milestones.

      • Services already rendered, such as consultancy sessions or technical support.

  • Refund Process:

    • Clients must submit a refund request in writing via email to info@sofstack.com.

    • The refund request should include the reason for the request and supporting documentation, if applicable.

    • Approved refunds will be processed within 7-14 business days.

  • Non-Refundable Services:

    • Custom software development and consultancy services are non-refundable once the work has commenced or deliverables have been provided.

3. Cancellation Policy

  • Cancellation by Clients:

    • Clients may cancel the project by providing written notice at least 5 business days before the next scheduled milestone.

    • A cancellation fee equivalent to 20% of the total project cost may apply, depending on the stage of the project.

    • If the project is canceled after partial work has been completed, no refunds will be issued for work already performed.

  • Cancellation by the Company:

    • We reserve the right to cancel the project under the following circumstances:

      • Non-payment or delayed payments beyond agreed terms.

      • Failure of the client to provide necessary inputs or resources for project completion.

    • In such cases, no refunds will be issued for completed work.

4. Dispute Resolution

  • Any disputes related to fulfillment, refunds, or cancellations will be handled as per the terms outlined in the client agreement.

  • Disputes that cannot be resolved amicably will be subject to arbitration or legal proceedings, as specified under the governing law in the agreement.

5. Governing Law

  • This policy and any disputes arising from it are governed by the laws of India, and clients agree to submit to the jurisdiction of courts located in Noida, UP.
